1. Introduction
These Terms of Service (“Terms”) govern the use of the MyDrively application, web platform, and related services (“MyDrively”, “the Service”, “we”, “us”, “our”).
By creating an account or using MyDrively, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
2. Scope of the Service
MyDrively is a software tool intended for professional use by businesses and their authorized users, such as car dealerships, vehicle coordinators, and related personnel.
The Service may include features such as:
- Booking and scheduling
- Vehicle information management
- Customer contact information
- Test drive documentation
- SMS, email, and calendar integrations
- PDF generation and storage
MyDrively is provided as a tool only. We do not supervise, verify, or control how users operate vehicles, interact with customers, or perform business activities.
3. Website Use
The MyDrively website is provided to allow visitors to learn about MyDrively, contact us, request information, and access related resources.
Visitors must not:
- Attempt to gain unauthorized access to the website or its systems
- Interfere with the operation, security, or availability of the website
- Use the website for unlawful purposes
We reserve the right to modify, suspend, or discontinue any part of the website at any time without prior notice.
4. Eligibility and Accounts
You may use MyDrively only if:
- You are authorized by your employer or organization to use the Service
- You provide accurate and complete information when creating an account
Individuals under the age of 18 may use the Service only where permitted by applicable law and authorized by their employer or organization.
You are responsible for maintaining the confidentiality of your login credentials and for all activity performed under your account.
5. User Responsibilities
You are solely responsible for:
- All actions performed using your account
- All content you create, upload, send, or store in the Service
- Compliance with applicable laws, regulations, and internal company policies
- Ensuring that customer data is handled lawfully and appropriately
You must not:
- Use the Service for unlawful purposes
- Upload false, misleading, or unauthorized information
- Violate the rights of third parties
- Attempt to disrupt or misuse the Service
Reasonable Use
Features described as "unlimited", including bookings, vehicles, users, e-mails, notifications, storage, or similar functionality, are intended for normal and legitimate business use in connection with the operation of automotive dealerships and dealer groups.
Users must not intentionally, directly or indirectly, including through automated means, generate excessive usage that is unreasonable, abusive, fraudulent, disruptive, or significantly exceeds typical operational requirements.
MyDrively reserves the right to investigate unusual usage patterns and, where necessary, limit, suspend, or terminate access to protect the stability, security, and availability of the Service.
Where excessive or unusual usage results in disproportionate costs, technical impact, or operational burden to MyDrively, we reserve the right to require the customer to move to a custom agreement or other commercially reasonable arrangement.
6. Customer Data and Content
MyDrively allows users to store and process data such as customer names, contact details, bookings, and documents.
You acknowledge and agree that:
- You are the data controller for any personal data you enter into the Service
- You are responsible for having a lawful basis to process such data
- You are responsible for informing customers about how their data is used
Customer-related personal data may be automatically anonymized or deleted in accordance with MyDrively’s Privacy Policy and applicable data protection laws.
MyDrively does not verify the accuracy, legality, or appropriateness of user-provided data.
7. Data Storage and Third-Party Services
MyDrively relies on third-party infrastructure and services, including but not limited to:
- Google Firebase and Google Cloud Platform services (authentication, databases, storage and cloud infrastructure)
- Cloud messaging and email services
- SMS and calendar integrations
- Platform services provided by Apple and Google
Data is stored and processed using these third-party services according to their respective terms and policies.
MyDrively is not responsible for:
- Downtime, data loss, or service interruptions caused by third-party providers
- Security incidents originating from third-party platforms
- Changes in availability or functionality of external services
8. No Professional or Legal Responsibility
MyDrively does not provide legal, safety, insurance, or professional advice.
We are not responsible for:
- Test drive safety
- Vehicle condition
- Insurance coverage
- Compliance with traffic laws
- Customer agreements or disputes
- Accidents, injuries, or damages
All such responsibilities remain with the user and/or their employer.
9. No Financial Transactions with Users
MyDrively does not process payments from end users of the application.
Any commercial arrangements, licensing fees, or service agreements are handled separately through contracts between MyDrively and the user’s employer or organization.
10. Availability and Changes
We aim to provide a stable and reliable service, but do not guarantee uninterrupted availability.
The Service is provided “as is” and “as available” without warranties of any kind, except where such warranties cannot legally be excluded.
We may:
- Modify or discontinue features
- Update the Service
- Temporarily suspend access for maintenance or security reasons
We are not liable for consequences resulting from such changes except where liability cannot be excluded under applicable law.
11. Termination
We reserve the right to suspend or terminate access to the Service if:
- These Terms are violated
- The Service is misused
- Required by law or security considerations
You may stop using the Service at any time.
12. Limitation of Liability
To the maximum extent permitted by law:
MyDrively, its developers, owners, distributors, and affiliates shall not be liable for:
- Direct or indirect damages
- Loss of data, revenue, profits, or business opportunities
- User actions or omissions
- Third-party service failures
- Claims arising from customer interactions
- Accidents, misuse, or operational errors
Use of the Service is at your own risk to the extent permitted by applicable law.
13. Indemnification
You agree to indemnify and hold harmless MyDrively and its affiliates from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your content or data
- Violations of these Terms
- Violations of applicable laws
14. Changes to These Terms
We may update these Terms from time to time.
When material changes are made, users may be required to review and accept the updated Terms before continuing to use the Service.
The current version will always be available on the MyDrively website and, where applicable, within the application.
15. Language and Interpretation
These Terms of Service are available in multiple languages for convenience.
In the event of any conflict or inconsistency between translations, the English version shall prevail.
16. Governing Law
These Terms are governed by and interpreted in accordance with the laws of Norway, except where mandatory local laws apply.
